What is the Difference between a Will and a Living Will?
August 2, 2024 – Matthew S. Akers & Douglas McCarthy
While a will primarily deals with the distribution of assets after death, a living will focuses on healthcare decisions and end-of-life care preferences while the individual is still alive but incapacitated. A last will and testament, commonly referred to as a will, is a legal document that outlines how a person’s assets and properties should be distributed upon their death. A living will, also known as an advance medical directive, is a legal document that specifies an individual’s preferences regarding medical treatment in case they become incapacitated and unable to communicate their wishes.
